Sub Club Terms and Conditions
These Terms & Conditions (the “Terms”) are provided on behalf of DiBella’s Old Fashioned Submarines, LLC and its affiliates, subsidiaries, licensees and service providers (collectively, “DiBella’s Subs”, “we” or “us”). PLEASE READ THESE TERMS CAREFULLY. BY PARTICIPATING IN THE SUB CLUB PROGRAM, YOU AGREE TO BE BOUND BY ALL TERMS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, YOU CANNOT PARTICIPATE IN THE SUB CLUB PROGRAM.
General
Sub Club (the “Program”) is one way in which DiBella’s Subs thanks and rewards loyal customers for patronizing our restaurants and purchasing food, beverages and other products from DiBella’s Subs locations. With any qualifying purchase on food or beverage at DiBella’s, Sub Club members earn 2 points for every $1 you spend.
Members who have accumulated points can turn redeem those points for rewards at DiBellas.com or via the DiBella’s app. These rewards can be redeemed either online, via the app or in-restaurant. Members will also earn random rewards throughout the year dependent on their purchasing habits.
How do I get started?
If you have a smartphone, you can download our app via the Apple App Store or Google Play. You can also sign up by visiting our web site at www.dibellassubclub.com. Once you sign up, your welcome reward will be available immediately and you can start earning points towards future rewards!
How to Enroll in Sub Club
There are two (2) ways to enroll in Sub Club and begin accumulating points:
(1) Via DiBella’s Subs website: Visit the DiBella’s Subs website at www.dibellas.com and click on the Sub Club link. Follow the prompts to create a Sub Club account.
(2) DiBella’s Subs mobile app: Download the DiBella’s Subs mobile app through your mobile device's applications store. Follow the prompts within the DiBella’s Subs mobile app to create a Sub Club account.
Creating a Sub Club Account
You will be required to register and create an account to participate in the Program. When you create a Sub Club account, you will be required to create a password. You may not disclose your password to any third party. If you learn of any unauthorized use of your password or your Sub Club account, please contact DiBella’s Subs Customer Service at SubClub@dibellas.com.
Privacy
By participating in the Program, you consent for DiBella’s Subs to send you emails, SMS text messages and notifications through the DiBella’s Subs mobile app, among other means, regarding your participation in the Program and to provide you with information about offers and marketing programs. Please refer to and follow the opt-out procedures described in the DiBella’s Subs mobile app, emails and SMS text messages if you wish to cease receiving communications from DiBella’s Subs regarding the Program. Merely deleting the DiBella’s Subs mobile app from your device will not cause you to cease receiving communications from DiBella’s Subs.
Please refer to the DiBella’s Subs Privacy Statement located at www.dibellas.com carefully to understand how DiBella’s Subs collects, uses and discloses information about customers.
The Privacy Statement is hereby incorporated by reference in these Terms.
By participating in this Program, you agree to: (i) the use by DiBella’s Subs of your name, city and state of residence and likeness for advertising, promotional and other purposes in any and all media now or hereafter known throughout the world in perpetuity without additional compensation, notification or permission, unless prohibited by law; and (ii) to release, discharge and hold harmless DiBella’s Subs, and its respective parents, affiliates, subsidiaries, retailers, distributors, suppliers, advertising, consultants, service providers and promotion agencies, and any other individuals engaged in any way in the development, production, printing, distribution or execution of this Program, and the respective directors, officers, and employees of the foregoing from any liability, claims, losses and damages arising out of or relating to your participation in this Program. By participating in this Program, you expressly understand and agree that DiBellas’s Subs shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages arising out of or related in any way to your participation in this Program.
Program Mechanics
At the register, provide your phone number or email on your DiBella’s Sub Club account to the register operator prior to closing out your transaction or use your mobile app scanning feature to self-identify and your points will automatically be added. You can also open your app after checking out and scan the barcode on the bottom of your receipt to earn points.
With any qualifying purchase on food or beverage at DiBella’s, Sub Club members earn 2 points for every $1 you spend. To receive points on catering orders, guests must e-mail their invoice to SubClubCatering@dibellas.com.
Points expire after one year from purchase.
Types of Rewards: Points can be exchanged for rewards either in the mobile app or at DiBellas.com. Rewards are various, and can include, but are not limited to, dollars off purchases and free menu items. Only one reward can be used at a time and cannot be combined with other discounts. DiBella’s Subs will notify you via email, mobile app notification, and/or SMS text message at various times regarding your Reward status.
Reward Redemption: Rewards will be stored within your Sub Club account. There are three (3) ways to redeem your reward.
(1) Provide your phone number or e-mail to the DiBella’s cashier prior to closing out your transaction and let them know which of your rewards you would like to use.
(2) Open the DiBella’s Sub Club app prior to paying the cashier, click either “View Rewards” or the QR code in the top right corner of the screen, and scan the associated barcode for the specific reward at the register.
(3) For online or in app orders, rewards can be redeemed at the checkout screen by clicking “Apply” next to the associated reward you would like to redeem.
You can check your account for current rewards and view expiration dates (if applicable) by logging into your account at DiBella.com or via the mobile app.
How to Leave the Sub Club Program: Contact us at 1-877-698-5285 to delete your Sub Club account. This can also be done in the app by going to your profile and clicking “Delete account”
Other Program Benefits and Rewards: DiBella’s Subs may choose to offer other Program benefits, rewards, offers or contests at any time. Please refer to these Terms, which will be updated in the event of any new benefits, rewards, offers, or contests that may be offered through the Sub Club program. You may or may not receive e-mails, SMS text messages, or mobile app notifications in the event of any new Program benefits, rewards, offers or contests.
There are no membership fees associated with the Sub Club Program. Rewards accumulated under the Program are promotional, have no cash value, and cannot be redeemed for cash or cash equivalents. You acknowledge and agree that you have no property interest in any Reward. Your Points, Rewards, and your Sub Club account are personal to you and may not be sold, transferred, shared or assigned. You may have only one (1) Sub Club account.
Eligibility
This program is not targeted towards, nor intended for use by, anyone under the age of 13. By participating in the Program, you acknowledge that you are 13 years of age or older. If you are between the ages of 13 and 17, you may only use the Program under the supervision of a parent or legal guardian who agrees to be bound by these Terms and the DiBella’s Subs Privacy Policy. Please contact Customer Service at SubClub@dibellas.com if you have any questions about the Program.
Changes and Modifications
These Terms do not alter in any way the terms or conditions of any other agreement you may have with DiBella’s Subs for products, services or otherwise. DiBella’s Subs reserves the right, at any time and in its sole and absolute discretion to change, modify and/or eliminate the Program and/or these Terms or any policy, FAQ, or guideline pertaining to the Program without notice to you. We may make these changes even though the changes may affect the value of your Points or Rewards already accumulated at any time and from time to time. Any changes or modifications will be effective immediately upon posting the revisions to www.dibellas.com and/or the DiBella’s Subs mobile app and you waive any right you may have to receive specific notice of such changes or modifications. Your participation in the Program confirms your acceptance of these Terms and any such changes or modifications; therefore, you should review these Terms and applicable policies frequently to understand the terms and conditions that apply to the Program. If you do not agree to the Terms, you agree to stop participating in the Program. DiBella’s Subs reserves the right to terminate your account and/or your participation in the Program if DiBella’s Subs determines in its sole discretion that you have violated these Terms, you have more than one (1) Sub Club account, or that the use of your account is unauthorized, deceptive, fraudulent or otherwise unlawful.
Dispute Resolution and Applicable Law
ARBITRATION AGREEMENT:
You must first contact Customer Service at SubClub@dibellas.com regarding any dispute relating in any way to your participation in the Program. Customer Service and/or other DiBella’s Subs personnel will work with you to resolve the dispute. In the event that a resolution is not achieved, you agree that any dispute or claim relating in any way to your participation in the Program and any disputes related thereto will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. For the purposes of clarity, contacting Customer Service is a condition to initiating arbitration proceedings. The Federal Arbitration Act and federal arbitration law apply to these Terms.
There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow the terms of these Terms as a court would. Either party may initiate the arbitration process by filing the necessary forms with the American Arbitration Association (AAA). The arbitration will be conducted by the AAA under its rules, including the AAA's Supplementary Procedures for Consumer-Related Disputes. The AAA's rules are available at www.adr.org or by calling 1-800-778-7879. Payment of all filing, administration and arbitrator fees will be governed by the AAA's rules. We will reimburse those fees for claims totaling less than $10,000 unless the arbitrator determines the claims are frivolous. Likewise, DiBella’s Subs will not seek attorneys' fees and costs in arbitration unless the arbitrator determines the claims are frivolous. You may choose to have the arbitration conducted by telephone, based on written submissions, or in person in the county where you live or at another mutually agreed location.
We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration we each waive any right to a jury trial. We also both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights.
By participating in the Program, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the state of New York, without regard to principles of conflict of laws, will govern any dispute of any sort that might arise between you and DiBella’s Subs.
